LEASE CONTRACT

Brillion Seeder
Calvert Soil Conservation District (hereto referred to as the District) is able to make available to limited resource farmers and persons interested in installing best management practices, John Deere No-till Drill, Great Plains No-till Drill, and Brillion Seeder.
In order to administer the program and provide needed maintenance and repair, a fee will be assessed to each leasee as outlined in the following terms of lease:
1. Rental Equipment must stay within Calvert County. Also, the equipment is not to be moved at night for safety reasons.
2. The responsible party that is leasing the equipment must sign a contract in advance, and that person will be held liable for the safe transportation and use of the drill.
3. The equipment will be used in the manner it was intended for as outlined in the operator's manual. The Leasee will be held responsible for any damage to the equipment from negligence or improper use as determined by a District Representative.
4. A fee will be assessed at $7.00 per acre and $25/day. The Leasee must call the District upon completion and report total acres planted. Office hours for reporting acreage is Monday through Friday between the hours of 7:30 a.m. and 4:30 p.m.
5. Hold Harmless: YOU ASSUME ALL RISKS inherent in the operation and use of the rental equipment by you and anyone else. You agree to assume the entire responsibility for the defense of, and to pay indemnity and hold us harmless from, and release us from any and all claims for damage to property or bodily injury(including death) or from loss of time or convenience resulting from the use, operation, or possession of the rental equipment, whether or not it be claimed or found that such damage or injury resulted in whole or in part from our negligence from the defective conditions of the rental equipment or from any other cause.
6. RENTER RESPONSIBILITY: It is the responsibility of the renter to pickup and deliver the equipment to its point of storage.
7. DAMAGE TO TOW VEHICLE: Calvert Soil Conservation District is not responsible for any damage to any and all tow vehicles used to tow the equipment rented under this Agreement.
8. CHARGES AND PAYMENT: You are responsible for the rental charges from the total days the drill/seeder was used and total acres planted with drill/seeder as specified on the Agreement. You will also be charged for an additional rental fee of 1.5 percent of the amount invoiced after 30 days. A $25 charge will also be assessed if the implement on the drill/seeder is not cleaned inside and out after use.
9. REPOSSESSION: You give the Calvert Soil Conservation District and it's representative the right to enter your property to inspect or repossess the equipment at any time. You hereby waive the right of action against the equipment at any time. You hereby waive any right of action against the Calvert Soil Conservation District or it's representative for such entry and retaking. In addition, you acknowledge that the consignment, misappropriation, sale, or failure to return the rented equipment within a reasonable time may constitute a crime.
An Operator's Manual will be available at the District office and in the grain bin on the drill.
It will be the responsibility of the Leasee to inspect the equipment prior to use and report any problems at that time to the District. In the event the equipment does not work properly or equipment fails during use, the problem is to be immediately reported to the District. In either case, the equipment should not be used until repaired or authorized by the District. Failure to report the need for repair or the continued use of the equipment when not functioning properly will be cause for the Districts full compensation of repair costs from the Leasee.

LEASE TERMS AND CONDITIONS
1. INSPECTION: YOU acknowledge that prior to taking the rental equipment, YOU examined it, and that it is in good condition except for any defect noted on this contract.
2. EQUIPMENT FAILURE: YOU agree to immediately discontinue use of the rental equipment should at any time it become unsafe or in a state of disrepair, and immediately notify us of the facts. Should the equipment become unusable the charges under this agreement will cease.
3. EQUIPMENT MAINTENANCE: YOU must remove remaining seed from seed bins and grease drill prior to drill leaving your property. Any delays in this will result in additional daily fees being added to your bill.
4. WARRANTIES:
There are no warranties either written, expressed or implied.
5. TRANSPORTAIONS: Transportation on state and
county roads, if not by tractor, will require at a minimum a 1/2 ton truck.
If the drill is transported by other than insured farm equipment, a Certificate
of Insurance showing a minimum of $100,000 liability will be required to be
on file with the District prior to transportation. If the Leasee does
not have the means to transport the drill, please call the District so the
alternative means of transportation can be located.
"I have read the terms of the Lease Contract and the attached information sheet. I understand the charges and procedures as outlined for the lease of the District Equipment. I will to the best of my ability provide the utmost care in transportation and use of the equipment while in my possession."
"I agree to call (410) 535-1521, ext. 3 and give the total acreage planted and total number of days used within a working day of completion of planting."

The District promotes the use of No-till and conservation tillage as best management practices to reduce sediment and nutrient runoff from agricultural activities. We wish you a successful planting season and a good crop.

OBSERVE THE FOLLOWING INSTRUCTIONS
BEFORE USE:
-- Check hydraulic couplings on drill. They will not fit all equipment.
-- Secure safety chains, hydraulic cylinders safety locks, hydraulic
hoses, and tongue pin for transport.
-- Observe slow moving vehicle speed when transporting on public roads.
-- Closely follow operator's manual (located in small seed hopper).
-- Check all nuts, bolts, screws, and connections for tightness.
-- Do not fill seed hoppers until in the field.
-- Disengage any unused drives.
-- Check calibration..Use seed chart only as a guide for calibration.
It is not a guarantee of the correct amount of see to be sown die to variations
in seed type and seed mixtures. Refer to the operator's manual for instructions
on calibrating the drill.
-- Remove Safety locks on hydraulic cylinders on each side of drill
for planting.
DURING USE:
-- Keep all nuts, bolts, screws, and connections tight. Check
for tightness daily.
-- Watch hydraulic hoses. They can burst and cause serious injury.
-- Do Not turn sharp corners with drill.
-- Do Not exceed recommend operating speeds.
-- Do Not attempt to clean or adjust the drill while it is in motion.
-- Do Not allow any person to ride on the drill.
-- Do Not walk near any unshielded chains or sprockets while the drill
is in motion.
-- Maximum speed in favorable conditions is about 4 to 5 miles/hour
AFTER USE:
-- Call the District at (410) 535-1521 ext. 3 to report total acres
planted. Hours 7:30am-4-30pm weekdays.
-- Help avoid spreading any obnoxious weed. Clean drill.
-- Install safety locks on hydraulic cylinders on both sides of drill
for transport.
-- Replace operator's manuals back in small seed hopper.
-- Remember to replace original hydraulic couplings on equipment.
